Alumni Reunion Digital Archives Personal Submissions Release and License
This document is called the “Release” and it allows Emerson College and individuals or organizations authorized by Emerson College to use certain photographs, video and/or audio recordings, written works, performance works, and other materials I submit in connection with an Emerson project to gather personal accounts and creative works (“Personal Submissions”) relating to community members’ experiences during their enrollment at Emerson College (“Alumni Archives Project”) without restrictions. The Release is submitted to Emerson College, and to any person or organization authorized by Emerson College, referred to together as “Emerson.”
I have received good and valuable consideration, including the opportunity to participate in the Alumni Archives Project. In exchange, I give the following rights to Emerson College:
- This is a non-exclusive license to Emerson and this document does not prevent me from licensing the Personal Submissions to other entities or from sharing or publishing them on my own, subject to applicable laws or terms that might govern any agreements I may make with third parties. Emerson is not providing me any legal advice about such agreements.
- I hereby license Emerson the complete rights to use the Personal Submissions and electronic files containing them or submitted with them in any way. They may be used or displayed anywhere in the world, for any reason, and Emerson may edit or modify them at any time as it sees fit in accordance with its mission. Emerson may use the Personal Submissions in any media it chooses, including, but not limited to, social media, websites, and exhibits. Emerson may store the Personal Submissions in archives and make them publicly available.
- I give Emerson the right to use names, voices, likenesses, and biographical information about me (“Information”) in connection with the Personal Submissions in any manner, for any reason, anywhere in the world and in any media it chooses, including, but not limited to, social media, websites, and exhibits. Emerson may store the Information in archives and make it publicly available.
- Emerson may combine the Personal Submissions and Information with other materials.
- I represent and warrant that I have all rights to provide the Personal Submissions and Information to Emerson, and that doing so does not violate any copyright, right of privacy, or any other right of any person or entity. I understand that any violation of this warranty could cause extensive financial, legal and reputational harm to Emerson.
- If I am a student, I understand that the Personal Submissions and Information may constitute educational records protected by the Family Education Rights and Privacy Act (FERPA). I hereby waive my rights under FERPA with respect to the Personal Submissions and Information, and consent to Emerson sharing them as outlined in this Release.
- I understand that Emerson has no obligation to use the Personal Submission and Information I provide.
- I have no claims against Emerson concerning the Personal Submissions and Information and will not bring any claims. By claims, I mean legal claims and demands including infringement of copyright or other intellectual property rights, libel, invasion of privacy, or violation of the right of publicity.
- I hereby release Emerson and its employees, trustees, students, agents, and representatives from any liability, claims, and demands of any type arising out of or relating to its use of the Personal Submissions and Information.
- I confirm that I am completely authorized to sign this Release. I read and approved this Release, I am at least 18 years old, and I am above the age of majority in my state of residence.
- This Release is the only agreement about the Personal Submissions and Information. This Release cannot be changed unless Emerson College and I agree to and sign a modification.
- My signature is being transmitted electronically, via a checkbox I selected. I agree it has the same effect as though it were provided in original ink form and I will not contest this document on that basis.
